I-360  Petition for Amerasian, Widower, or Special Immigrant

Purpose of Form: To apply for certain benefits granted to Amerasians, Widow(er)s, battered spouses or children of U.S. citizens, or other special immigrants as defined in the form's instructions.

Where to file: Submit your filing to the USCIS Office identified with your petition category:

Self-Petitioning Spouse or Child of an Abusive U.S. Citizen: File at the Vermont Service Center

Special Immigrant - Religious Worker: File at the Service Center with jurisdiction over the state where you will be residing.

Widow(er): File with your I-485 at the local USCIS Office with jurisdiction over your place of residence; if you are filing without an I-485, file the petition at the USCIS Service Center with jurisdiction over your state of residence; if you are outside the U.S., and are filing without an I-485, file at the Foreign USCIS Office with jurisdiction over your place of residence.

Special Immigrant - Military: If you are filing with an I-485, and are in the U.S., file at the local USCIS Office with jurisdiction over your place of residence; if you are filing without an I-485, and are in the U.S., file at the Service Center with jurisdiction over your place of residence; if you are filing without an I-485 and are outside the U.S., file at the Foreign USCIS Office with jurisdiction over your place of residence.

Special Immigrant - Juvenile: File your petition with the local USCIS office with jurisdiction over your place of residence.

Amerasian: If you are living in the U.S., file your petition with the local USCIS Office with jurisdiction over your place of residence; if you are living outside of the U.S., you can either file your petition with the Foreign USCIS Office that has jurisdiction over your current place of residence, or you can file your petition with the local USCIS Office that has jurisdiction over your intended place of residence in the U.S.

Special Immigrant - Physician: File your petition with the USCIS Service Center with jurisdiction over your place of residence

Special Immigrant - Panama canal: File your petition with the USCIS Service Center with jurisdiction over your place of residence.

Special Immigrant-International Organization Officer or Employee and Family Members: Use the addresses listed below when mailing Form I-360 and associated forms and correct fees, to USCIS. Please note that there is a different address if you are filing only Form I-360, if you are filing it concurrently with Form I-485 or if a Special Immigrant International Organization Officer or Employee and Family Members I-360 has been previously approved.

No fee for:

Amerasians;

Self-petitioning battered or abused spouses, parents or children of U.S. citizens or permanent residents; or,

Special Immigrant Juveniles

All others, the fee will be $375.

WARNING: USCIS Filing Fee: $375 total which is $295 plus $80 biometric services fee.

Exception: No filing fee for Amerasians. Amerasian sponsors must still pay the $80 biometrics fee.
